By accepting service from Simple Pest Management (SPM), you agree: You may cancel as follows: (i) California cooling-off—if this Agreement is signed away from SPM’s usual place of business, you may cancel for any reason by sending written notice so that SPM receives it by midnight of the third business day after you sign. (ii) Scheduling policy—separately, you may cancel or reschedule any appointment by sending written notice so that SPM receives it at least 24 hours before the scheduled service time (Pacific Time). Late cancellations, no access, or missed appointments may be charged up to the service fee. Statutory cancellation rights apply in addition to this policy; card payments include a 4% processing fee (waived on request). Regular services begin on the initial service date and continue at the stated frequency; after any initial term, service renews month-to-month until canceled with 60-day written notice. Early termination fee (ETF) of $200 applies if canceled prior to the agreed initial term. SPM may also recover any promotional credits, waived fees, or discounts applied to the account, and all amounts accrued remain due.

Flex Trial Plan: up to 60 days of treatment; cancel anytime within 60 days by written notice and no further service will be performed. If not canceled within 60 days, the plan automatically converts to a 12-month agreement.

VIP Priority: unlimited free re-treatment as product labels and safety allow; accounts may be placed on hold by paying only the monthly VIP fee. Non-VIP accounts receive up to two free re-treatments per rolling 12-month period.

All re-services require the account to be in good standing and reasonable cooperation (e.g., sanitation, exclusion, correcting conducive conditions). SPM will re-treat affected areas at no charge if issues arise and as the label allows; non-maintenance plan customers are covered for 30 days from the last service. Provide access (unlock gates, secure pets); if interior areas are inaccessible, SPM may perform exterior service, leave a record, and charge the standard fee; re-treatment or exterior-only service does not extend the term. SPM does not guarantee total eradication; multiple treatments may be required and service dates are estimates. If sensitive to odors/chemicals, consult a physician.

To the fullest extent permitted by law, SPM’s total liability is limited to amounts you paid to SPM; SPM is not liable for lost use, revenue, profits, or incidental/consequential/punitive damages; aesthetic concerns from exclusion work are non-refundable. All disputes are resolved by binding, individual arbitration in San Diego, CA under AAA rules (no court/jury or class actions). Except for any written warranties expressly provided by SPM, all services and products are “AS IS.” California law governs; if any term is unenforceable, the remainder stays in effect. State law requires that you be given the following information: CAUTION—PESTICIDES ARE TOXIC CHEMICALS. Simple Pest Management is a registered structural pest control company. We are regulated by the Structural Pest Control Board. We use pesticides approved by the California Department of Pesticide Regulation and the United States Environmental Protection Agency. Registration is granted only when the state finds that risks are minimal if used properly or outweighed by benefits. Risk depends on exposure. Exposure should be minimized.

If within 24 hours after application you experience flu-like symptoms or other unusual symptoms, contact your physician or poison control center at 1-800-222-1222. Also contact Simple Pest Management immediately.
